Policy on Responsible Lending

As a responsible lender, we commit to you that this loan product abides by all applicable laws and that we strive for the utmost level of transparency and fairness. Responsible Lending

NOT FOR ALL FINANCIAL NEEDS: This loan is designed to help with your immediate cash needs. It will not solve your long-term needs and refinancing will result in additional charges. We encourage you to (1) borrow only what you need and can repay and (2) shop the marketplace until you are convinced that you have found the best possible solution. You may choose to consult a consumer credit counseling service for other options.

TRANSPARENCY OF COSTS FOR YOUR LOAN: The cost of credit will be clearly disclosed to you in terms of the dollar amount of interest and the APR according to the principles of federal truth in lending law and regulations. For details on the specific costs of your loan, please see your personalized loan agreement. Late fees and non-sufficient funds/returned item fees may apply as described in your loan agreement. We will never charge you any "hidden fees" that are not fully disclosed in the loan agreement or the Loan Cost & Terms.

RIGHT OF RESCISSION: If you change your mind about the loan, you may rescind your loan at no charge as long as you return the loan proceeds within the number of days specified in your loan agreement.

IMPLICATIONS OF LATE AND NON-PAYMENT: If you don't make a payment on time we will attempt to contact you via one or more authorized methods, including phone calls, emails, and text messages to arrange for payment. All of our collections methods will be in accordance with the principles of the federal Fair Debt Collection Practices Act (FDCPA). In addition, we may re-present any returned payments to your bank in accordance with applicable law and regulatory requirements. If we are unable to reach you or we are unable to collect against your debt we may place or sell your debt with third party collection agencies. However, we only contract with collection agencies that agree to follow the FDCPA. Furthermore, since we may report loan payments to one or more credit bureaus, late or non-payment of your debt may impact your credit rating. As noted above, late fees and non-sufficient funds/returned item fees may apply as described in your loan agreement.

RESPONSIBLE RENEWALS AND REFINANCING OPTIONS (SUSTAINED USE): This is a short term loan, you can either pay the loan off according to the terms of the loan agreement or pay it off early to save additional finance charges. If you become eligible we will notify you of any new loan options you may have. We will not change your loan without your express permission pursuant to the terms of your loan agreement. We strongly encourage principal reduction and early payment to reduce your additional finance charges.

We will restrict your ability to renew or refinance your loan after you have had an outstanding balance with us for a period of 12 consecutive months. After you have paid in full the outstanding balance of your loan account, you may apply for a new loan. Depending on the payment method you choose, it may take 1-3 business days to process the payment that brings your account balance to $0.

COMPLIANCE WITH LAWS: We abide by all applicable State and Federal law in accordance with the choice of law provision as governed by the state of Utah. As such, we follow the principles of applicable federal lending laws where they don't conflict with the choice of law provision. These laws include (but are not limited to):

Sigma Solutions Inc. (“SIGSOLINC”) is providing you the following information in a manner consistent with principles under United States federal law. Application Verification

You authorize Sigma Solutions Inc. (“us” or “we”) to verify the information given in connection with this loan application, and you give us consent to obtain information about you from a consumer reporting agency or other sources to verify all of the information you have provided us, including past and/or current information. If there is any missing or erroneous information in or with your loan application regarding your Bank Account (including without limitation your bank, bank routing number, or account number), you authorize us to verify and correct such information.

Advertising

SIGSOLINC will not engage in advertising practices or other outgoing communications that would discourage on a prohibited basis the making or pursuing of an application for credit.

Notification

SIGSOLINC will provide notices of action taken on loan applications in a manner consistent with the principles of the Equal Credit Opportunity Act and Federal Reserve Board Regulation B.

CREDIT REPORTING DISCLOSURE

We may make inquiries concerning your credit history and standing, and may report information concerning your performance including, but not limited to, late payments, missed payments, or other defaults, to credit reporting agencies. Late payments, missed payments or other defaults on your Loan may be reflected in your credit report.

COLLECTION AND USE OF BANK ACCOUNT AND OTHER INFORMATION ABOUT YOU

As part of our credit underwriting and information collection process, we will consider the bank account information provided by you as eligible for us to process payments against, we may detect additional bank accounts under your ownership, and we also may collect and consider information about you from non-credit reporting agency data providers and publicly available information about you.

COOKIES AND ONLINE ADVERTISING

To ensure we are publishing content customers need and want, SIGSOLINC collects aggregated site visitation statistics using cookies. When someone visits the web site, a cookie is placed on the customer's computer (if the customer accepts cookies). We also advertise our products and services on other websites you might visit. We may use certain third party vendors, including but not limited to, Google, Microsoft, or Yahoo, to place our ads on other websites. These third parties may use the cookies placed on your computer to show you advertisements for our services (based on your prior visits to this website) on other internet websites. You can opt out of Google's, Microsoft's and Yahoo's use of cookies in this manner by visiting their respective advertising opt-out pages. Automatic Logging of Session Data

This Agreement shall be subject to any other agreements you have entered into with SIGSOLINC.

Certain sections or pages on the Site may contain separate terms and conditions of use, which are in addition to the terms and conditions of this Agreement. In the event of a conflict, the additional terms and conditions will govern for those sections or pages.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of the Agreement shall remain in full force and effect.

General Provisions

This Agreement supersedes any previous Terms of Use Agreement to which you and SIGSOLINC may have been bound. This Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. All rights not expressly granted herein are hereby reserved. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
